Hey all! Quick replys are appreciated! I bought a 2001 S60 T5 (114K miles) from a Volvo dealership on Saturday only to have the autostick transmission go out 10 miles away! Upon the purchase, I did opt for the optional 1 year warranty so I'm covered, but...the dealer wants to talk to me on Wednsday about our "options."

This car has every option available and it did drive great on the test drive. It is black with tinted windows and the body is in pretty good shape! All the routine service was also performed at this dealership.

I need your advice...come Wednsday, the dealer is probably going to try and get me into another S60, perhaps newer and with less miles so I don't force them to replace the tranny. They are contractually obligated to perform the repair, however I don't want to rule anything out as it seems I have the negotiation advantage.

What would you do? How much newer/less miles of a car would their offer have to be to make it mutually beneficial to both parties? Or, am I better off getting them to replace the tranny in the '01 S60 T5 I originally picked out?

This is my first Volvo, so any advice you have would be greatly appreciated.

They would still need to put in a new tranny, so in all likelyhood they would replace the tranny and then resell the car for a couple grand more than what you paid for it. At the same time get you to pay more for a newer car.

IMO, if you like the car, keep it (with a new tranny of course).

In total agreement, have them do the repairs since you like the car. Unless they are willing to trade you up to a 06. :thumbsup:

Agree. Get the new transmission. Even if you get a newer car you still don't know how the transmission was treated and with this one you will.

:) Agree with the others., if you like the vehicle, keep it....Also go over that extended warranty you purchased with the car...Am sure you have a deductible, but reading ALL the fine print is for a lawyer to decipher...You may need it again sooner than you think.....Good luck

UPDATE: Talked to dealer and they are refusing to make repairs to the vehicle. They claim that the warranty I purchased doesn't become active until 45 days after the contract is signed. Instead, they want to put me into a 2.4 non turbo base model with a fraction of the options my T5 had AND put down an additional $1,000!!! OR they offered to reverse the transaction. Said the new tranny costs $5,000 and that I could pay that if I wanted. Plus, there is/was your typical courtesy 1-2 month warranty.

I told them to listen to the recording and they'll hear their finance guy explain that I'm covered for a year or 12,000 miles...no mention of a 45 day window when I'm out of pocket for repairs. Then I told him (pre-owned manager) to talk to the general manager then get back to me with how they are going to fix the situation.

They are essentially breaking a contract that is legally binding. But after consulting with attorneys, the legal fees to force them to uphold their end of the deal would probably be enough to pay for the repairs.

So, unless someone knows someone at Volvo of Dallas who can make this situation right, it looks like they've won. I'll probably return the loaner car I have now and drive home my 1997 Camry that was traded in and report them to the BBB.

Why does your lawyer feel that it will even go to court? Any time a dealership makes a financially hindering transaction of course they will say they will void the contract and start over. If its a Volvo dealership that sold it, then Volvo technicians went over the car prior to your purchase. Contact Volvo US to get them into the loop, this may help even though each dealership is independently owned. Go over the contracts you signed and look at the fine print. Personally I would get all my money back and walk away from the deal and consider myself lucky. This vehicle has a known major issue, and the authority(dealership) in your area wants an arm and two legs for the repair. Remember, dealerships LIE all the time, they are in it for the money.

The lawyer doubts it will go to court, but just going through the motions and drafting various letters will incur attorneys fees...he's a good lawyer!

Yes, it is a Volvo dealership (Volvo of Dallas...who claim to sell the most Volvos in Texas). I spoke to the service representative myself who said everything checked out.

Good idea about speaking to Volvo US, though I'll probably do that after I get my Camry back. I'm still waiting to hear back from the dealership...the ball is in their court right now. I've resigned to cancel the deal, but I gave them one more shot at trying to make this situation right. If their prior actions are any indications, they'll fail.

UPDATE! Just got off the phone with the dealership and they FINALLY offered to replace the transmission at no additional cost. This is what they should have done in the first place, but at least they are trying to make it right.

I'll keep ya'll posted and will post some pics of the car when I eventually get it back!!

Guys-

I picked up my car last week and so far so good! Everything checks out and it shifts fine. The dealer picked up the entire cost, after lots of arm twisting. I'm happy with the outcome as I finally ended up with the car I wanted in the first place. GREAT stereo!! And those heated leather seats work quick!

Yeah, its got some miles on it, but maintance records check out and I only put 3,000 miles annually on my car so I can justify this one...I live just 0.7 miles from the office and ride my bike sometimes. :)
