Ok so this is how it went down, approaching a roundabout (uk type) turning right - indicating, check- exit is clear, check gap in traffic safe to go, round the small dot in the road, Bl@@dy hell where did tghat pedestrian come from. If he had been an inch closer I would have stopped on his toes!! If he had been 3 " further they would have been scrapeing him off my front bumper as I stopped 3 foot past him. he had a wave and rant at me but I decided as I didnt hit him I would just leave before I lost my temper with him.
Why would I lose my temper you ask, - because part of the reason I didnt see him until it was too late was the fact I was checking the state of the traffic lights and pedestrians on the bl@@dy crossing 30 feet away. he had skirted outside the railings that stretch 40 foot either side of the crossing and was crossing at the widest point of the road at the roundabout, I guess he started crossing as I pulled out and was keeping a watchful eye on the traffic coming from the other direction as I rounded the crossing - as I straightened my attention went to the pedestrian crossing, I bet hes going to report me for dangerous driving - thats the soort of **** that he is. aargh

FWIW, people usually assume the driver of the car is at fault in pedestrian accidents, but most of the time it is the pedestiran's fault.

The fact that the highway code applies to pedestrians as well seems to be totally ignored. The basic concept of not crossing on or near junctions is purely there for the safety of them but when they do and things go wrong it is the driver that is held to book since they are the one who is insured and the one who assumes greater responsibility since they are in control of the metal.

Frustrating isnt it

Good thing you only nearly hit a pedestrian and not a bicycle or similar. Panel contact with metal objects can have adverse affects on the paintwork.
